PROMOTION RULES AND REGULATIONS

NO PURCHASE NECESSARY: By entering this Sweepstakes, entrants agree to abide by these Sweepstakes Rules and Regulations (the “Official Rules”). The decisions of the Sponsor with respect to all aspects of the Sweepstakes are final. The information you provide will only be used to administer the Sweepstakes in accordance with the Sponsor’s privacy policy.

 1.      SWEEPSTAKES PERIOD: The 2018 ROCKWOOL “Use it Rate it Win it” Sweepstakes (the “Sweepstakes”) is sponsored by ROXUL Inc.(“Sponsor”). The Sweepstakes begins at 12:00:00 AM Eastern Time (“ET”) on January 1, 2018 and ends at 11:59:59 PM ET on December 31, 2018 (the “Sweepstakes Period”).

 2.      ELIGIBILITY: The Sweepstakes is open to legal residents of Canada who have reached the age of majority in their province or territory of primary residence at time of entry and to legal United States residents residing in the fifty (50) United States and the District of Columbia (excluding Puerto Rico, the U.S. Virgin Islands and other U.S. territories and possessions) who are eighteen (18) years of age or older or the age of majority in their state of residence, whichever is older, at the time of entry. Employees of the Sponsor, its affiliated partners, agents, distributor network, their respective advertising or promotional agencies (such entities, collectively, the “Promotion Entities”) or members of any such employee’s immediate family (regardless of where they live) or persons with whom such employees reside (whether related or not) are ineligible to enter or win. “Immediate family” includes spouses or domestic partners and parents, siblings, children and their spouses and domestic partners. Commercial customers of the Sponsor are not eligible to participate in the Sweepstakes.

3.      HOW TO ENTER THE SWEEPSTAKES: No Purchase Necessary. There are two (2) methods of entry to earn entries (the “Entry”) into the Sweepstakes:

        i.            WEBSITE REVIEW: During the Sweepstakes Period visit www.rockwool.com/rateit (the “Sweepstakes Website) and click on the product review link that applies to the Participating Product you would like to submit a review for. Please note: you must visit each product review page from the Sweepstakes Website in order to be entered in the Sweepstakes. Next, complete the entry form with your nickname (to be used for your ROCKWOOL review) and a valid email address. Upon completion of the entry form follow the on-screen instruction to submit a review (the “Review”) of one (1) of the following Products: ROCKWOOL COMFORTBATT®, ROCKWOOL SAFE’n’SOUND® or ROCKWOOL COMFORTBOARD™ IS (the “Participating Products”)by completing your review headline, a rating of the Participating Product, and in the comment section complete a review of the Participating Product as directed (see rule 4). Once your Review is complete, click on the “Submit” button and you will receive one (1) entry (the “URL Entry”) into the applicable Monthly Prize Period (see rule 5) provided the review is in compliance with rule 4. All Reviews must reflect the entrant’s honest experience with the Participating Product being reviewed. Each Review will automatically disclose that the Review is being provided in exchange for an entry into this Sweepstakes. URL Entries must be received during each Monthly Prize Period (as outlined in rule 5) to be entered into the applicable Monthly Prize Period.

      ii.            WITHOUT PURCHASE: To enter the Sweepstakes by mail without submitting a Review, on a plain piece of paper, print by hand your full name, complete mailing address (including postal code), daytime telephone number (including area code), valid email address and mail along with a minimum 50-word essay on “Why you are a fan of the ROCKWOOL brand and its products” (the “Mail-In Entry”). Residents of Canada must mail to: The 2018 ROCKWOOL Use it Rate it Win it Sweepstakes, Dept 3714, Box 9500 Lakeshore West PO, Oakville, ON L6K 0G4. Residents of the United States must mail to: The 2018 ROCKWOOL Use it Rate it Win it Sweepstakes, Dept 3714 PO Box 23806, Rochester, NY, 14692-3806. In order to be entered into the respectable Monthly Prize Period, Mail-in Entries must be postmarked by the applicable Monthly Prize Period end date (see rule 5) and received by the applicable Monthly Prize Period’s draw date (see rule 5). No copies, facsimiles or mechanical reproductions will be accepted. Sponsor assumes no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage due entries or mail.  Limit one (1) entry per outer mailing envelope.

Limit of one (1) Review per Participating Product during the Sweepstakes Period.  For greater certainty, a maximum of three (3) Entries can be earned during the Sweepstakes, regardless of method of entry. You may only use one (1) email address to enter the Sweepstakes.  In the event it is determined that an entrant has entered in a fashion not sanctioned by these Official Rules and/or has submitted more than the number of Entries permitted by these Official Rules, the entrant will be disqualified and all of the Entries submitted by the entrant will be disqualified.

 4.      REVIEW FORMAT AND CONTENT. 

Each Review that is submitted must meet the following “Review Requirements” (any Review that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified):

 ·           Review of each Participating Product may include a review of the physical product, your experience installing the product, experiencing the effect of ROCKWOOL using the Product, experience with a ROCKWOOL rep in store or in-store experience purchasing the product, experience seeing a ROCKWOOL demo, social media, or advertisements of the product;

•  must not describe any life threatening or dangerous activity;
• must be no more than one hundred fifty (150) words in length;
• must be written in English or French;
• must not violate any law, statute, ordinance or regulation;
• must not have been previously published
•  must not include reference to third parties/people, who have not expressly authorized entrant to reference their image or likeness in the review for purposes of this Sweepstakes. Third Parties include, but are not limited to, celebrities, friends, and minors who have not obtained parental consent prior to such participation;
• must be owned solely by the entrant; and
•   must be unique and only submitted once in this Sweepstakes.

In addition, a Review must not reference any other content: (i) that is unlawful, hateful, offensive, disparaging, discriminatory, libelous, inappropriate, sexually explicit, or obscene; (ii) which incites, solicits, promotes, or provides information about illegal or criminal activities; (iii) that abuses, threatens, promotes, or instigates physical harm or death to others, or yourself; (iv) that promotes and/or contains the addresses of other websites; (v) that victimizes, harasses, degrades, or intimidates an individual or group of individuals on any basis, including but not limited to religion, gender, sexual orientation, race, ethnicity, age, or disability; (vi) that constitutes unauthorized or unsolicited advertising, junk or bulk emails (also known as “spamming”), chain letters, pyramid schemes, the promotion of particular stocks of shares and other financial products and services, or any other form of unauthorized solicitation, or any form of lottery or gambling; (vii) that contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of this Sweepstakes or any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party; (viii) that impersonates any person or entity, including any of the Sponsor’s employees, dealers, or representatives; (ix) that solicits personal information from another entrant; (x) that, in any other manner, is deemed by the Sponsor to be inappropriate to the well-being of others; (xi) that communicates and/or exchanges a message of any kind, third party phone numbers, mobile numbers, emails or home addresses and any personal details; (xii) which is inconsistent with the positive messaging which the Sponsor wishes to communicate; (xiii) that disparages any persons or organizations, especially those associated with the Sponsor; and/or (xiv) that invades the privacy or other rights of any person, firm, or entity, all of which is to be evaluated by the Sponsor in its sole and absolute discretion; all as determined by the Sponsor at its sole discretion.

Any Review that the Sponsor deems, in its sole discretion, to violate the terms and conditions set forth in these Official Rules will be disqualified and the applicable entrant will not be provided an Entry in relation thereto.

 5.      MONTHLY PRIZE PERIODS: The Sweepstakes Period is divided intotwelve (12)Monthly Prize Periods as follows: 

6.      MONTHLY PRIZES: There are twelve (12) monthly prizes (each a “Monthly Prize” and, collectively, the “Monthly Prizes”) available to be won with one (1) Monthly Prize per Monthly Prize Period, each consisting of a $200.00 pre-paid gift card (the “Gift Card”). The currency of the Gift Card will be dependent upon whether the winner resides in the U.S. or Canada. Residents of the U.S. will receive a $200.00 (USD) Gift Card. Resident of Canada will receive a $200.00 (CDN) Gift Card.

Each Gift Card is subject to the terms and conditions of the issuer (see back of Gift Card for details and restrictions).  Each Gift Card has no cash surrender value and no expiry date. Any unused portion of a Gift Card will remain on the Gift Card until the total value of the Gift Card is used (for example: if the Gift Card is valued at $200 and $50 is used for the first purchase, $150 will remain on the card and so forth until the total value of the Gift Card is used). The issuer of the Gift Card is neither a sponsor nor partner of this Sweepstakes and bears no liability. Prizes must be accepted as awarded without substitution, are not transferable, not for resale and have no cash surrender value. The Sponsor reserves the right, in the event that a Prize cannot be awarded as described for any reason, to substitute another prize of equal or greater value, without liability.

 7.      MONTHLY PRIZE DRAWS: One (1) random draw for one (1) Monthly Prize, (each a “Monthly Draw”) will be held on each of the respective Monthly Draw Dates listed in the table in rule 5 in Oakville, Ontario from among all eligible URL Entries received during each applicable Monthly Prize Period and all Mail-in Entries received by each respective Monthly Draw Date. The odds of being selected as a Monthly Prize selected entrant will depend on the total number of eligible Entries received during each applicable Monthly Prize Period.  PLEASE NOTE: Non-winning Monthly Entries WILL be carried over into subsequent Monthly Prize Periods.  Each Monthly Prize selected entrant will be contacted by telephone and/or email within three (3) business days of the applicable Monthly Draw Date.

 8.   GENERAL: By entering the Sweepstakes, entrants agree to abide by these Official Rules and the decisions of the Sponsor and the independent Contest organization with respect to all aspects of the Sweepstakes, which decisions are final. By entering, each entrant consents to the use of his/her Review(s) without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor.

9.      WINNER NOTIFICATION (for Canadian Residents ONLY): To be declared a Prize Winner, the selected entrant must answer correctly, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question posed by email or telephone. The selected entrant will also be required to sign a Declaration and Release Form (the “Release Form”) confirming compliance with the Official Rules, acceptance of the Prize as awarded, without substitution, and releasing the Sponsor, its dealers, agents, affiliated and related companies, advertising and promotional agencies, the independent promotion organization and their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns (collectively, the “Releasees”) from any liability in connection with the Prize or this Sweepstakes. The Release Form must be returned within the time period specified on the Release Form or the Prize may be forfeited. If a selected entrant (a) cannot be reached by telephone and/or email within five (5)business days of the first notification attempt; (b) fails to correctly answer the skill testing question; or (c) fails to return the properly executed Release Form within the specified time; then he/she will be disqualified and another entrant will be selected until such time as contact is made by telephone and/or email with a selected entrant or there are no more eligible entries, whichever comes first.  The Sponsor will not be responsible for failed attempts to contact a selected entrant. 

10.  WINNER NOTIFICATION (for US Residents ONLY): US selected entrants will be contacted by telephone and/or email to confirm his/her eligibility and to provide his/her contact information. 

11.  AWARDING OF PRIZES. In the event a Monthly Prize is awarded to a Canadian resident, the Monthly Prize will be mailed to the applicable winner within thirty (30) days of the Sponsor’s receipt and verification of his/her Release Form (and subject to compliance with all other condition and requirements provided in these Rules). In the event a Monthly Prize is awarded to a U.S resident, the Monthly Prize will be mailed to the applicable winner within thirty (30) days of the winner confirming his/her eligibility and providing his/her contact information.

12.  REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION:  Each person who enters this Sweepstakes represents and warrants as follows: (i) the Review is the entrant’s own original, previously unpublished, and previously unproduced work; (ii) the review does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; and (v) the review does not and will not violate any applicable laws, and is not and will not be defamatory or libelous.  Each entrant hereby agrees to indemnify and hold the Promotion Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

13.  PUBLICITY RELEASE By participating in the Sweepstakes, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any entrant in or winner of the Sweepstakes, each entrant irrevocably grants the Sponsor and its successors, assigns and licensees, the right to use such entrant’s name, likeness, biographical information in any and all media for any purpose, including without limitation, advertising and/or promotional purposes as well as in, on or in connection with the Sweepstakes Application or the Sweepstakes or other promotions, and hereby release the Sponsor from any liability with respect thereto.

14.  The Releasees accept no responsibility for any loss, damage or claims caused by or resulting from the Sweepstakes or any Prize. By entering, each declared winner consents to the use of his/her name, address (city and province), Photo and/or Story, likeness and/or photograph, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor where permitted by law.

15.  The Releasees will not be responsible for late, lost, illegible, incomplete or destroyed entries; all such entries are void. The Sponsor and the independent contest organization will not be liable for any failure of the Sweepstakes Website, do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof or any e-mail message or other communication sent or received during the Sweepstakes Period, for any reason.  Entry material/data that have been tampered with or altered are void.  The use of an invalid email address will disqualify the entry. Users spamming the same email address will disqualify the entry.

16.  In the event of a dispute, Entries will be deemed to have been submitted by the authorized account holder (defined below) of the email address submitted at the time of entry.  “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address with the selected entry.  If the identity of an entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address. The sole determinant of the time for the purposes of a valid entry in this Sweepstakes will be the promotion server machine(s).

17.  The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (the “Régie”) in the Province of Québec, to terminate or amend this Sweepstakes at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Sweepstakes is not capable of running as originally planned, such as tampering, the Sponsor reserves the right with the consent of the Régie, to cancel the Sweepstakes and conduct a draw from all previously received eligible entries received by the Sweepstakes Closing Date. The Sponsor and the independent Contest organization shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Sweepstakes, including, but not limited to, any damage to an entrant’s mobile phone, computer equipment, system, software or any combination thereof, as a result of the entrant’s participation in this Sweepstakes.

18.  All entries become the permanent property of the Sponsor and none will be returned. No correspondence will be entered into, except with the selected entrants. The Sweepstakes is subject to all applicable federal, provincial, territorial and municipal laws.

19.  For the winner’s list, send a self-addressed, stamped envelope by December 31, 2017 to:  The ROCKWOOL Use it Rate it Win it Sweepstakes-Request for Winner’s list, dept 3714 PO Box 23806, Rochester, NY, 14692-3806. The winner’s list to be available January 31, 2018. 

20.  For Québec residents only: Any litigation respecting the conduct or organization of a publicity Sweepstakes may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

21.  The Sponsor respects your right to privacy.  Personal information collected from entrants will only be used by the Sponsor to administer the Sweepstakes and, only if consent is given at the time of entry, to provide the entrants with information regarding upcoming promotions and/or events from the Sponsor.  If entrants provide consent when entering the Sweepstakes, entrants consent to the manner of collection, use and disclosure of personal information as set out in the Sponsor’s privacy statement, which is available at:https://www.ROCKWOOL.com/privacy
